Consumer Health Data Privacy Policy
This Consumer Health Data Privacy Policy applies to “consumer health data” as defined by the Washington My Health My Data Act (and comparable state health-data laws). It supplements the HerEstrogen Privacy Policy and describes how consumer health data is collected, used, shared, and protected, and the rights you have over it. HerEstrogen is a brand operated by VH Ventures LLC.
1. Scope
This policy applies only to consumer health data as defined by the Washington My Health My Data Act. It supplements, and does not replace, the HerEstrogen Privacy Policy. Where this policy and the Privacy Policy differ with respect to consumer health data, this policy controls.
2. Categories of consumer health data we collect
- Health conditions, symptoms, and health status you report through the intake questionnaire.
- Information about medications, treatments, allergies, and medical history you provide.
- Information that indicates you are seeking or receiving health care services — for example, pages you view about specific treatments, or your completion of an intake questionnaire.
- Contact and account information collected alongside the information above (such as your name, email address, and phone number).
- Data that may be used to infer or derive any of the categories above.
3. Where this data comes from
We collect consumer health data directly from you — through the intake questionnaire, when you create an account, and through your communications with support. We do not purchase consumer health data from data brokers.
4. Why we collect and use it
- To connect you with licensed clinicians for evaluation.
- To enable a licensed clinician to review your intake and determine whether treatment is appropriate for you.
- To enable licensed pharmacies to fill a prescription if one is issued.
- To provide ongoing care, support, and account servicing.
- To comply with our legal obligations.
5. Categories of third parties we share it with
- Licensed clinicians and the affiliated professional entities that evaluate your intake.
- Licensed pharmacies that fill prescriptions.
- Technology service providers (processors) that operate the platform on our behalf under written agreements, including a HIPAA Business Associate Agreement where applicable.
- Parties to a corporate transaction, such as a merger, acquisition, or sale of assets.
- Government agencies or other parties where required by law or valid legal process.
- Analytics providers, only if you have affirmatively consented. Analytics on this website are switched off by default. If you accept analytics on our consent banner, Google (Google Analytics, delivered via Google Tag Manager) receives the addresses of the pages you view on this website, which can include pages about specific treatments or symptoms. If you decline, do not respond, or send a Global Privacy Control signal, Google receives nothing. You can withdraw consent at any time using the “Do Not Sell or Share My Personal Information” link in the footer, which also deletes those cookies. Google is never sent the health information you enter in the intake questionnaire.
6. Affiliates
HerEstrogen is operated by VH Ventures LLC. Consumer health data is processed by our clinical technology provider, Bask Health Inc., by the treating professional entity, Beluga Health, P.A., and by the licensed dispensing pharmacies described in Section 5. VH Ventures LLC has no other corporate affiliates that receive consumer health data.
7. Your rights
Under the Washington My Health My Data Act, you have the right to:
- Confirm whether we collect, share, or sell your consumer health data.
- Access your consumer health data.
- Obtain a list of all third parties and affiliates with whom we have shared your consumer health data, along with contact information for each recipient.
- Withdraw your consent to our collection and sharing of your consumer health data.
- Delete your consumer health data.
We will respond to a verified request within 45 days, as required by the Act. If we need more time, we will tell you within that period and explain why.
8. How to exercise your rights
To exercise any right above, email support@herestrogen.com. We may need to verify your identity before acting on your request.
If we deny your request, you may appeal by emailing support@herestrogen.com with the word “Appeal” in the subject line. We will inform you in writing of our decision on the appeal. If your appeal is unsuccessful, you may file a complaint with the Washington State Attorney General at www.atg.wa.gov/file-complaint.
9. Sale of consumer health data
HerEstrogen does not sell consumer health data.
10. Effective date and changes
This policy is effective as of the date shown above. If we make material changes, we will update the effective date and post the revised policy on this page. Where required, we will provide additional notice.
