Terms of Service
1. Acceptance of Terms
Welcome to HerEstrogen ("HerEstrogen," "we," "our," or "us"). By accessing or using www.herestrogen.com, creating an account, completing an intake, communicating with the clinical team, or purchasing services, you agree to these Terms of Service. If you do not agree, do not use this website or services.
2. Eligibility
You must:
- Be at least 18 years old;
- Reside within the United States, in a state where independent licensed clinicians at our medical partner (OpenLoop Health) are authorized to provide telehealth services;
- Provide truthful, accurate, and complete information — including a valid date of birth, which our medical partner uses to verify your candidacy for treatment; and
- Be legally capable of entering binding agreements.
3. Medical Services Are Provided by Independent Clinicians
HerEstrogen does not practice medicine. HerEstrogen facilitates access to independent licensed healthcare professionals through our medical partner, OpenLoop Health. All medical decisions — including diagnosis, treatment, prescriptions, lab orders, dosage adjustments, and eligibility determinations — are made solely by licensed clinicians in their independent clinical judgment.
Use of HerEstrogen does not guarantee:
- A diagnosis;
- Prescription approval;
- Medication eligibility; or
- Any specific treatment outcome.
Hormone therapy is not appropriate for everyone. Clinicians may decline to prescribe at their sole medical discretion based on your clinical picture, contraindications, or state-specific prescribing laws.
4. Telehealth Consent
You consent to receive medical services via telehealth as permitted in your state. You understand that telehealth has limitations and that an in-person visit may be more appropriate in some circumstances. You may withdraw your consent to telehealth at any time without affecting future care; withdrawal does not retroactively affect care already provided.
The full informed-consent document used by our medical partner is available at openloophealth.com/telehealth-consent. By initiating an intake on HerEstrogen, you affirm that you have reviewed and agree to that telehealth consent.
5. No Emergency Services
6. Account Responsibilities
You are responsible for:
- Maintaining the confidentiality of your account credentials;
- Providing accurate intake information; and
- Updating medical information when changes occur.
You may not share your account with another individual.
7. Plans, Billing & How to Cancel
HerEstrogen offers prepaid plans of 3, 6, or 12 months. Billing for your plan is processed by our medical partner, OpenLoop Health, at the time you complete intake. Plan prices, payment terms, and any renewal mechanics are governed by the terms you accept with OpenLoop during checkout. See OpenLoop's Terms of Use for subscription, billing, and cancellation mechanics, and OpenLoop's Telehealth Consent for the consent you provide at intake.
Plan options
- 3-month plan: $477.00 total ($159/month).
- 6-month plan: $762.00 total ($127/month effective).
- 12-month plan: $1,140.00 total ($95/month effective).
How to cancel
You may cancel at any time by emailing support@herestrogen.com with the subject line "Cancel". Cancellation requests are forwarded to OpenLoop Health for processing within one business day of receipt.
To ensure your cancellation takes effect before any next renewal charge, we request that you send your cancellation at least 72 hours prior to your next billing date. If a cancellation request is received within 72 hours of the next billing date, the next charge may still process and the cancellation takes effect for the cycle after that. The cancellation process is designed to be at least as straightforward as the signup process, consistent with the FTC Negative Option Rule and applicable state automatic-renewal laws. See the full Cancellation & Refund Policy for refund eligibility.
State-specific notices
If you are a California resident, you may report complaints to the California Department of Consumer Affairs, Consumer Information Division (dca.ca.gov), 1625 North Market Blvd., Suite N-112, Sacramento, CA 95834, or by phone at 1-800-952-5210.
REQUIRES COUNSEL REVIEW: partner-billing disclosure language, state-specific renewal-reminder timing, applicable mini-FTC rules, and how to align this section with OpenLoop's billing terms.
8. Refund Policy
HerEstrogen's full Cancellation & Refund Policy is published as a separate document so it stays consistent with the refund terms required by our medical partner. See the complete policy at herestrogen.com/refunds.
In summary:
- You may cancel at any time by emailing support@herestrogen.com with the subject "Cancel". Cancellation requests received at least 72 hours before your next billing date take effect for the next cycle.
- You receive a full refund if a clinician determines hormone therapy is not medically appropriate for you, or if you cancel before your medication has been ordered.
- Due to federal pharmacy regulations, refunds are not available after your medication has been ordered/shipped.
- For multi-month plans (6- or 12-month), partial refunds are calculated on a prorated basis at the 3-month plan rate ($159/month) — see refunds.html for the calculation example.
To the extent of any conflict between this summary and the full policy at refunds.html, the full policy controls.
9. Communications Consent
By providing your contact information, you consent to receive:
- Appointment and refill reminders;
- Care updates from the clinical team;
- Account notifications; and
- Educational content related to your plan.
Marketing emails and SMS messages are sent only with your separate opt-in (which you provide on the intake by checking the SMS consent box). You may opt out of marketing communications at any time by replying STOP to any SMS or clicking the unsubscribe link in any email. Reply HELP for help. Message frequency varies; message and data rates may apply. Consent to marketing is not a condition of any purchase.
10. Important Safety Information (Prescription Products)
Estrogen-containing products carry FDA boxed warnings for endometrial cancer; cardiovascular disorders including stroke, heart attack, and venous thromboembolism (deep-vein thrombosis and pulmonary embolism); probable dementia; and, in combination with progestins, breast cancer. Use the lowest effective dose for the shortest duration consistent with treatment goals and your individual risk profile.
The medications we coordinate access to are FDA-approved branded or generic estradiol and oral progesterone products. We do not market mass-compounded BHRT. Discuss risks, benefits, contraindications, and alternatives with your clinician before starting treatment.
Report adverse events to the FDA MedWatch program at fda.gov/safety/medwatch or 1-800-FDA-1088.
11. Intellectual Property
All content on HerEstrogen — including branding, text, graphics, workflows, logos, educational materials, and software — is owned by Her Estrogen, PBC and protected by intellectual-property laws. You may not copy, reproduce, or distribute materials without written permission.
12. Disclaimers
Information on this site is for general educational purposes and is not medical advice. Individual results vary. The intake completed on this site does not, by itself, create a doctor-patient relationship. A clinician-patient relationship arises only when an independent licensed clinician at OpenLoop Health accepts you as a patient. HerEstrogen is not a healthcare provider — we coordinate access to independent licensed clinical services.
13. Limitation of Liability
To the fullest extent permitted by applicable law, HerEstrogen and its affiliates, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to your use of the services, even if we have been advised of the possibility of such damages. Medical outcomes cannot be guaranteed.
14. Dispute Resolution & Arbitration
REQUIRES COUNSEL REVIEW. Subject to counsel approval of the specific language below, the parties agree as follows:
- Pre-arbitration notice. Before filing a claim, you and HerEstrogen agree to first attempt to resolve any dispute informally by sending a written notice describing the claim to legal@herestrogen.com. We will attempt to resolve within 30 days of receipt.
- Binding arbitration. Any unresolved disputes will be resolved by individual binding arbitration administered by [arbitration body — to be set with counsel] in accordance with its then-current consumer rules. Class actions and class-wide arbitration are not permitted.
- 30-day opt-out. You may opt out of this arbitration agreement by emailing legal@herestrogen.com with the subject "Arbitration Opt-Out" within 30 days of first agreeing to these Terms. Opting out does not affect any other provision of these Terms.
- Carve-outs. Nothing in this Section limits your right to: file a complaint with a state medical board or pharmacy board; file a HIPAA complaint with HHS OCR; pursue claims in small-claims court for individual disputes within the court's jurisdictional limit; or exercise any non-waivable right under applicable consumer-protection or telehealth law.
15. Governing Law
REQUIRES COUNSEL REVIEW. These Terms will be governed by the laws of the state of [to be set with counsel], without regard to its conflict-of-laws rules, except that the Federal Arbitration Act governs the arbitration provision and any state-specific consumer-protection rights that cannot be waived by contract continue to apply.
16. Changes
We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last Updated" date. Continued use of the site after a change indicates acceptance of the updated Terms.
